Welcome to ToniCes.
These Terms of Use ("Terms") govern your access to and use of tonices.us, ToniCes accounts, community features and other services made available through ToniCes.
By accessing or using ToniCes, you agree to these Terms and to any policies referenced here, including the Community Guidelines and Privacy Policy.
If you do not agree, do not use the site.
1. Adults Only
ToniCes contains explicit adult material.
You may use ToniCes only if you are 18 years of age or older and meet any higher minimum age required by the laws that apply where you live.
By entering or creating an account, you confirm that you meet the applicable age requirement and are legally permitted to view adult content.
If you do not meet that requirement, you may not access or use ToniCes.
2. About ToniCes
ToniCes is an independent site centered on fictional characters, computer-generated 3D artwork, comics, stories and related community features.
The artwork and publications displayed by ToniCes are curated by the site. Members currently cannot upload their own publications or image galleries, although they may interact through features such as profiles, avatars, comments, reactions and collections where available.
Features may change over time.
3. Accounts
Some ToniCes features require an account.
When creating and using an account, you agree to:
- Provide information reasonably necessary to create and maintain the account
- Keep your login credentials secure
- Use only an account you are authorized to control
- Maintain a username, avatar, profile and community activity that comply with these Terms and the Community Guidelines
- Notify ToniCes if you believe your account has been compromised
You are responsible for activity carried out through your account unless the activity results from a security failure attributable to ToniCes.
ToniCes may restrict, suspend or terminate accounts that violate these Terms, the Community Guidelines, applicable law or the security of the service.
4. Community Conduct
Interactive areas of ToniCes are governed by the Community Guidelines.
Among other things, you may not use ToniCes to:
- Harass, threaten or target other people
- Engage in racism, unlawful discrimination or abusive conduct
- Doxx another person or attempt to expose private identifying information
- Promote, request or encourage sexual content involving minors or characters depicted as underage
- Promote, request or encourage bestiality, rape or sexual violence, scat, urine or vomit fetish content, or extreme gore
- Impersonate another person
- Spam or manipulate site features
- Attempt to circumvent access controls, membership restrictions, moderation or security systems
- Interfere with the operation of ToniCes
- Use the service for unlawful purposes
Not every harmful or disruptive behavior can be listed in advance. ToniCes may take reasonable moderation action where conduct clearly undermines the safety, integrity or intended use of the community.
5. Avatars and Profile Content
Adult or suggestive avatars, including nudity, may be permitted.
ToniCes may require the removal or replacement of avatars that are excessively sexually graphic for general community areas, including imagery focused prominently on genitals, explicit sexual acts or material primarily intended to shock or provoke.
Profile information, avatars, usernames, comments and other member-provided material must comply with the Community Guidelines.
By submitting profile or community content, you confirm that you have the right to use it and grant ToniCes a non-exclusive permission to display, store, reproduce and technically process that material only as reasonably necessary to operate the relevant site feature.
You retain whatever ownership rights you otherwise have in material you submit.
6. ToniCes Content and Intellectual Property
Unless otherwise stated, the ToniCes site, its original artwork, site design, text, branding and other original material are protected by applicable intellectual-property law.
Access to ToniCes does not transfer ownership of ToniCes content to you.
You may view and use the site for personal purposes and for any additional purposes expressly authorized by ToniCes.
You may not reproduce, redistribute, sell, scrape, republish or commercially exploit ToniCes content in a manner not authorized by the relevant rights holder or by law.
Some artwork may depict characters, brands, designs or other material owned by third parties. Rights in such underlying material remain with their respective owners.
Copyright concerns are handled under the DMCA / Copyright Policy.
7. Memberships
ToniCes may provide access to exclusive content based on paid memberships maintained through third-party services such as Patreon and SubscribeStar.
When supported, you may connect those accounts to ToniCes so the site can verify your membership status and grant the appropriate access.
Your payment relationship is with the membership provider you used. Billing, renewals, cancellations, refunds and payment disputes are generally governed by that provider's terms and procedures.
ToniCes does not guarantee uninterrupted access when a membership provider is unavailable, delays synchronization, changes its API or reports your membership as inactive, expired, refunded, reversed or otherwise ineligible.
ToniCes may correct access when membership information was granted in error or when a provider reports that the relevant entitlement is no longer active.
8. Commissions
Commissioned artwork is governed by the terms agreed for the commission and by the current Commissions information published by ToniCes.
Unless otherwise agreed:
- The final price is agreed before payment
- Full payment is required before work begins
- A commission request is not accepted merely because an idea was submitted
- Reasonable minor revisions may be allowed during the preview stage
- Major changes may require an additional fee
- ToniCes will ask for permission before publicly posting a commissioned image
The client may receive broad rights to use the final commissioned image as agreed, but a commission does not transfer ownership of pre-existing characters, trademarks, designs, 3D assets or other third-party intellectual property appearing in the image.
Where a third-party payment provider is used, that provider's own terms may also apply.
9. Achievements and Site Features
Achievements are optional site features intended to mark activity or milestones.
They do not represent money, property, membership status or any entitlement outside ToniCes.
Achievement requirements, availability, names, artwork or rules may change over time. ToniCes may introduce, retire, correct or revoke achievements where reasonably necessary, including when one was granted because of an error or abuse.
Other site features may likewise be modified, added or discontinued as ToniCes evolves.
10. Third-Party Links and Services
ToniCes may link to or integrate with third-party websites and services, including social platforms, membership providers and advertisers.
ToniCes does not control those third parties and is not responsible for their content, availability, security, privacy practices or independent actions.
Your use of third-party services is subject to their own terms and policies.
11. Advertising
ToniCes may display third-party advertising.
Advertising is separate from ToniCes editorial content and does not imply endorsement of an advertiser, product or service.
ToniCes is not responsible for transactions, representations or services offered by third-party advertisers. If you choose to interact with an advertisement or advertiser, that relationship is between you and the third party.
12. Copyright Complaints
ToniCes respects intellectual-property rights.
If you believe content available on ToniCes infringes copyright that you own or are authorized to represent, please follow the site's DMCA / Copyright Policy.

13. Moderation, Suspension and Termination
ToniCes may remove comments, profile material or other member-provided content and may restrict community features where reasonably necessary to enforce these Terms or the Community Guidelines.
Depending on the circumstances, ToniCes may issue warnings, suspend an account, restrict features or permanently terminate access.
Serious violations may result in immediate action.
ToniCes may also take action to protect the site against fraud, security threats, attempts to bypass access controls or other technical abuse.
14. Availability and Changes
ToniCes is an evolving independent project.
The site may be changed, updated, interrupted or temporarily unavailable for maintenance, technical problems, provider outages or other reasons.
ToniCes does not promise that every feature, publication, membership integration, achievement or other part of the service will remain available forever.
Where reasonably possible, significant changes will be introduced without unnecessarily disrupting existing users.
15. Disclaimer
ToniCes is provided on an "as available" basis.
To the maximum extent permitted by applicable law, ToniCes makes no guarantee that the service will always be uninterrupted, error-free or compatible with every device, browser or third-party service.
Nothing in these Terms excludes warranties, remedies or consumer rights that cannot legally be excluded in your jurisdiction.
16. Limitation of Liability
To the maximum extent permitted by applicable law, ToniCes and the person or persons operating it will not be liable for indirect, incidental, special or consequential losses arising solely from use of or inability to use the site, third-party services, advertisements or external links.
This limitation does not apply where liability cannot legally be limited or excluded.
17. Privacy
Your use of ToniCes is also subject to the Privacy Policy, which explains the categories of information processed by the site and how that information is used.
18. Changes to These Terms
ToniCes may update these Terms as the site, its features or applicable requirements change.
The date at the top of this page indicates the latest revision.
If a change is material, ToniCes may provide additional notice through the site where appropriate.
By continuing to use ToniCes after revised Terms take effect, you agree to the updated Terms, except where applicable law requires a different form of consent.
19. Applicable Rights
These Terms are intended to operate alongside applicable law, not replace rights that the law makes mandatory.
Consumer, privacy and other statutory rights that cannot legally be waived remain unaffected.
